Terms of Use / Licensing

Please read carefully. By purchasing a product from hausofunequal.com, you agree to be bound by these Terms. You are purchasing a licence to use a file — not the copyright to the file itself.

1. INTRODUCTION & ACCEPTANCE

1.1 These Terms of Service ("Terms") govern your purchase of digital goods from Haus of Unequal ("we", "us", "our") via hausofunequal.com.

1.2 By purchasing a product, you ("the Customer") explicitly agree to be bound by these Terms.

1.3 These Terms are governed by and construed in accordance with the laws of England and Wales. Where you are located in the United Kingdom, these Terms are drafted in compliance with the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (the "Consumer Contracts Regulations 2013"). Where you are located outside the United Kingdom, you may also have rights under the applicable laws of your jurisdiction, and nothing in these Terms is intended to exclude or limit those rights to the extent they cannot lawfully be excluded.

2. IMVU ASSET LICENSING AGREEMENT

2.1 Grant of Licence: Upon purchase, we grant you a non-exclusive, non-transferable, revocable licence to use the purchased 3D asset, texture, or mesh ("the Product").

2.2 Platform Restriction: The Product is licensed strictly for use on the IMVU platform. You are expressly prohibited from importing, uploading, or using the Product on any other platform, game engine, or virtual world without a separate commercial licence, which Haus of Unequal does not currently offer.

2.3 CID Lock: The licence is valid only for the specific IMVU Catalog ID (CID) associated with your account at the time of purchase.

  • You may not transfer the licence to a different IMVU account.
  • If you use multiple accounts, you must purchase a separate licence for each CID.

2.4 Derivability: Unless the Product is explicitly sold with a "Master" or "Derivability" licence, you are strictly prohibited from setting the Product as derivable in the IMVU Catalog. Doing so constitutes a material breach of this agreement.

2.5 Unauthorised Distribution: You must not resell, redistribute, share, or leak the raw files (textures, meshes, XMFs, XRFs) to any third party under any circumstances.

2.6 Unlawful Extraction of 3D Assets: You must not extract, reverse-engineer, decompile, or otherwise derive the underlying 3D mesh data, bone structures, or geometry from any file provided as part of a Product. This prohibition applies regardless of the tool or method used and regardless of whether the extraction is for personal, commercial, or any other purpose. Violation of this clause constitutes a material breach of these Terms and may result in immediate termination of your licence without refund.

3. INTELLECTUAL PROPERTY & AI PROHIBITION

3.1 Ownership: Haus of Unequal retains full intellectual property ownership, copyright, and title to all Products.

3.2 No AI Training: You are strictly prohibited from using any Product — including its meshes, textures, or preview images — for the purpose of training AI systems, machine learning models, or generative networks (including but not limited to LoRAs, Stable Diffusion, or image-to-3D generators).

3.3 Copyright Claims: As a licensee, you have no legal standing to issue DMCA notices or copyright claims regarding our Products. All enforcement rights remain exclusively with Haus of Unequal. However, if you become aware of any suspected infringement, unauthorised distribution, or breach of these Terms — including instances of our Products being resold, leaked, or redistributed without authorisation — you must report it to us promptly at contact@hausofunequal.com. We take all reports seriously and will investigate accordingly.

4. PAYMENTS, DELIVERY & RIGHT TO CANCEL

4.1 Digital Delivery: Products are delivered via digital download links immediately upon successful payment.

4.2 Statutory Right to Cancel: Under the Consumer Contracts Regulations 2013, consumers normally have 14 days to cancel a contract. However, for digital content, this right ends once the download begins. By completing your purchase, you expressly consent to the immediate supply of digital content and acknowledge that you waive your right to cancel once access is granted.

4.3 Refund Policy:

  • Because you have waived your right to cancel under Clause 4.2, we do not offer refunds for change of mind or user error (such as providing an incorrect CID).
  • Under the Consumer Rights Act 2015, you are entitled to a repair or replacement if a Product is faulty (for example, a corrupt file or missing geometry).
  • If we cannot repair or replace the faulty Product within a reasonable time, you will be entitled to a full or partial refund.
  • Incompatibility caused by IMVU updates released after your purchase does not constitute a fault in the Product.

5. PLATFORM DEPENDENCY & LIMITATION OF LIABILITY

5.1 IMVU Independence: We are a third-party creator and are not affiliated with IMVU Inc. We accept no liability for IMVU server outages, changes to IMVU's Terms of Service that affect your account, or IMVU banning or disabling your account.

5.2 Liability Cap: Nothing in these Terms limits our liability for death or personal injury caused by negligence or for fraud. For all other claims, Haus of Unequal's total liability shall be limited to the purchase price paid for the specific Product giving rise to the claim.

5.3 Indemnity: You agree to indemnify us against any claims, damages, or legal costs arising from your breach of these Terms.

5.4 Technical Support: Our responsibility is limited to providing the file as described. We are not responsible for providing tutorials, training, or technical support on how to use IMVU Studio, Blender, or other third-party software. While we may offer community support via Discord, we are under no obligation to provide individualised technical training.

6. TERMINATION OF LICENCE

6.1 We reserve the right to immediately revoke your licence and ban your access to our store without refund if we have reasonable grounds to believe you have:

  • Shared the files with others
  • Used the files on a non-licensed CID
  • Attempted to use the files for AI training
  • Attempted to extract or reverse-engineer the underlying 3D mesh data or geometry
  • Initiated a fraudulent chargeback via your bank or PayPal

7. GOVERNING LAW

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
